CONTRACT TERMS AND CONDITIONS

The general contract terms and conditions referred to form an inherent part of the contract stipulated between yourself (the client) and Antony and Carol Roberts(from herein A&CR)

1. Terms and conditions for reservation and payment.

Once the reservation process has been completed, you will receive written confirmation to the same e-mail address. This confirmation will contain all the details of the reservation.

The moment the reservation has been made, the cancellation fee conditions detailed in these contract terms and conditions will become valid.

Once the reservation has been made, A&CR will charge the credit card made available by the client with a deposit of 25% of the total amount. The remaining 75% will be paid when the keys to the property are handed over.

If the 25% deposit cannot be made for reasons beyond A&CR control, A&CR reserves the right to cancel the reservation.

2. Cancellation of the reservation on behalf of the client

If a client cancels a reservation 15 to 10 days before the arrival date s/he will lose 5% of the total amount of the reservation fee. If the cancellation is made 10 to 3 days

before the arrival date, 15% of the total reservation fee will be lost and if the cancellation is made in the last 48 hours before arrival 25% will be lost. If the client does not show up on the day, s/he will lose 100% of the reservation fee and will be obliged to pay, making the payment pending after the initial deposit.

3. Arrival and departure

Once the client has arrived at the property, a rental contract will be signed by both parties with a clause shown in this document with a duration shown in the prior booking.

The arrival time for clients will be between 15:30 and 21:00. If a client cannot adapt to this time frame, s/he must inform A&CR beforehand.

Departure from the property will be 12:00 at the latest on the day of departure established in the rental contract.

4. Prices

The prices shown in the details of the reservation include taxes, electricity, water and gas, homeware, towels and bed linen.

5. Contractual conditions in the rental contract.

The client must sign a rental contract with the following clauses before s/he enters the property:

b) That as the client is interested in staying in the property described in the reservation document, they have agreed on the occupation of the aforementioned property,

reaching the following agreement:

FIRST.- A&CR allows the client, of legal age, to use the aforementioned, unoccupied property for the agreed period.

SECOND.- Once the duration period of the contract has expired, the client must leave A&CR the property and goods, the use of which is detailed in this contract, in perfect condition, with no more wear than occurs simply with time.

If the client desists from the contract before the full term of agreed occupation is up, no sum of money will be reimbursed.

For every day that passes after the contract has ended and the client has not left the property, there will be an additional sum of €500 per day added as a penalty clause.

THIRD.- The contract is for the accommodation of the client and the maximum number of occupants, established in the reservation document, may not be surpassed. If this were the case, the client will accept full responsibility and be liable for any consequences of the infraction.

If an unforeseen event were to occur for reasons beyond the control of either party, and which meant the property could not be inhabited at the last minute, A&CR would not incur any additional cost and without compensation.

FOURTH.- The client is obliged to provide a photocopy of both sides of his/her credit card and of his/her identity card or passport to allow the company to charge for any damage detected in the property in question. It is the responsibility of the client to look after the property, ensuring it is left in the same condition it was in when

the client arrived.

All damages, breakages and/or losses regarding the furnishings and items in the property must be reported to A&CR (Tel. 968 482587). The replacement of the items will be charged to the client's credit card according to the replacement value which appears on the inventory. The rental client will provide a deposit of one hundred Euros to cover any damage caused in the property.

Once the client has checked out and the property has been inspected, if any item is found to be missing or broken, or an accident has occurred which has not been

reported to the Reservations Department, the charge will be made to the credit card.

The loss of one of the front door keys, will incur costs of €100 + VAT which will be charged to the client's credit

card.

FIFTH.- Clients will allow authorised A&CR personnel access to the property at all times and with no notice to carry out inspections of services and facilities, or to check the contractual obligations are being fulfilled, as well as to carry out maintenance tasks.

SIXTH.- The property is part of a Joint Ownership Regime (Regimén de Propiedad Horizontal) and, as such, the client is subject to the current statutes and regulations of the Owner's Community which states to avoid problems and to help cohabitation the following must be taken into account:

- All rubbish should be deposited daily in plastic bags in the allocated bins.

- Excess noise is not permitted, such as: loud music or TV, door slamming, shouting, etc. in the property itself or its surroundings, especially not in residential areas at times of rest. Noise is a frequent cause of complaint among residents who may call the police if they are bothered.

- Before using the pool it is obligatory to have a shower as sun creams and tanning lotions damage the water purifiers. The client will accept full responsibility for any accidents occurred in private swimming pools. Children must be supervised at all times by an adult when they are using the pool.

- The windows and doors of the property must be shut when the client is out. A&CR reserves the right to cancel the reservation or request clients to leave without compensation if any of the guests show inappropriate behaviour.

- Any illegal or offensive behaviour will imply the intervention of the Local Police or of the Civil Guard if need be.

- Check-in time is from 15:30 to 19:00. Notice must be given of arrivals outside this time. Check-out will be up until 12:00. For any departures after 12:00 and before

16:00 there will be a €50 supplement. For departures after 16:00 a further night will be charged. T

- The client is not permitted to carry out any kind of building work on the rental property in question, neither may s/he change the positioning of the furniture in the property.
